In these terms and conditions, the words “website” refer to Awesome Maid LLC's website, “we”, “our”, and “Awesome Maid LLC” refer to Awesome Maid LLC, and “user” and “client” refer to you, the user or client of Awesome Maid LLC.

By using the website and services, you represent and warrant that you have full power, authority and capacity to enter into this agreement and to perform all obligations hereunder. You further represent and warrant that you are not subject to any legal incapacity or contractual restriction that would prevent you from entering into this agreement.

By providing their email address, users authorize Awesome Maid LLC to send them communications related to the services they have contracted, as well as informational and promotional messages, including newsletters and offers. The user may unsubscribe at any time using the option available in the emails or by sending a request through the contact channels indicated on the website. Awesome Maid LLC may use external providers to send these communications, ensuring the confidentiality and security of the user's information.

 

3. NATURE AND DESCRIPTION OF SERVICES

Awesome Maid LLC offers professional cleaning and property management services, including short-term rental cleaning, commercial cleaning, one-time residential cleaning, and recurring residential cleaning. All services are performed by trained staff using appropriate products and equipment and following high standards of quality and attention to detail. The specifications, prices, frequency, conditions, and other terms applicable to each service will be defined and agreed upon in writing in the respective service agreement entered into between Awesome Maid LLC and the client.

 

4. DISCLAIMER

Awesome Maid LLC provides its cleaning and property management services with the utmost diligence, professionalism, and commitment to quality; however, use of the website and contracting of services are done at the customer's sole responsibility. The company does not guarantee specific results beyond the proper execution of the contracted tasks, nor is it responsible for subjective expectations related to the appearance, smell, shine, or overall perception of the service result. The services of Awesome Maid LLC are strictly limited to cleaning, basic maintenance, and operational management of spaces, and do not include structural repairs, specialized maintenance, deep restoration, hazardous waste management, or any other activity that exceeds the scope of the contracted services.

The company assumes no responsibility for damage, loss, or malfunction caused by pre-existing conditions on the property, defective materials, poor facilities, or improper use of cleaning products by the customer. In short-term rental services, the company does not guarantee the occupancy of the property or the behavior of guests, limiting itself solely to cleaning, restocking, and preparing spaces according to the instructions of the owner or manager. In commercial and residential services, the company is not responsible for items left out of place or loss of valuables not previously reported or insured. Customers are advised to remove or secure fragile, valuable, or sensitive items before the service is performed.

The customer acknowledges that certain external factors—such as the condition of the property, limited access, lack of electricity or water supply, or unforeseen conditions—may affect the performance or quality of the service, without this giving rise to any liability on the part of Awesome Maid LLC. The company may reschedule or suspend the service when there are causes beyond its control, such as adverse weather conditions, emergencies, or risks to staff safety.

Furthermore, Awesome Maid LLC shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of income, business interruption, or any damages arising from the use or inability to use the services. The website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, regarding its accuracy, availability, reliability, or suitability for a particular purpose. The customer assumes all responsibility for the use of the information contained on the website and acknowledges that such information is provided for informational purposes only and does not constitute professional, technical, or contractual advice.

By contracting the services, the customer agrees that Awesome Maid LLC shall not be liable for any claims, losses, or damages exceeding the total value paid for the corresponding service. Any discrepancy or disagreement must be communicated in a timely manner, within twenty-four (24) hours of the service being provided, in order to allow for review and, if necessary, reasonable correction of the work. Continued use of the services implies full acceptance of this disclaimer and the exoneration of the company from any liability that exceeds the reasonable scope of the contractual obligations assumed.

 

5. COPYRIGHT 

All content available on the Awesome Maid LLC website, including, but not limited to, text, logos, images, photographs, icons, graphics, videos, downloadable materials, source code, site structure, and any other visual or functional elements, is the exclusive property of Awesome Maid LLC or is used under license or express authorization from its respective owners. Such content is protected by intellectual property laws, copyright laws, and other applicable regulations in the United States and other international jurisdictions.

  • Deep-link to any portion of the services for any purpose without our express written permission.

  • "Frame", "mirror" or otherwise incorporate any part of the website into any other websites or service without our prior written authorization.

  • Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Awesome Maid LLC in connection with the services.

  • Circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any content.

 

8. DISCLAIMER OF WARRANTIES 

Due to the nature of the Internet, Awesome Maid LLC provides and maintains the website on an "as is", "as available" basis and does not promise that use of the website will be uninterrupted or error free. We will not be liable to you if we are unable to provide the website or our services for any reason beyond our control.

Awesome Maid LLC shall not be liable in any amount for any failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control, including, without limitation, Internet outages, communications outages, fire, flood, war or any uncontrollable act of nature.

These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, Awesome Maid LLC excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Awesome Maid LLC and Awesome Maid LLC shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

  • Any incorrect or inaccurate information on the website.

  • The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website or service purchased through the website.

  • Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.

  • Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

  • Any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing or using content from the website or from transmissions via emails or attachments received from Awesome Maid LLC.

  • All representations, warranties, conditions and other terms which but for this notice would have effect.

 

9. INDEMNIFICATION

You agree to defend and indemnify Awesome Maid LLC from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • Your breach of this agreement or the documents referenced herein.

  • Your violation of any law or the rights of a third party.

  • Your use of the website and services.

 

10. CHANGES AND TERMINATION

We may modify the website and these terms at any time, at our sole discretion and without notice. You are responsible for keeping yourself informed of these terms. Your continued use of the website constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms. Unless otherwise specified, all changes to these terms apply to all users. In addition, we may terminate our agreement with you under these terms at any time by notifying you in writing (including by email) or without notice.

 

11. INTEGRATION CLAUSE

This agreement together with the privacy policy and any other legal notices published by Awesome Maid LLC, shall constitute the entire agreement between you and Awesome Maid LLC concerning and governs your use of the website and the services.

 

12. FORCE MAJEURE

Awesome Maid LLC shall not be liable for any failure or non-performance of services due to causes beyond its reasonable control, including but not limited to acts of civil authorities, acts of military authorities, riots, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances and which may prevent the performance of our services.

 

13. DISPUTE RESOLUTION 

Any dispute, claim, or controversy between the user and Awesome Maid LLC related to these Terms, the website, or the services shall be resolved exclusively through alternative dispute resolution methods.

Both parties will first attempt to resolve the matter informally through direct communication. Users may contact Awesome Maid LLC through its official support channels, and the company will respond within a reasonable period of time.

If the dispute is not resolved within thirty (30) days, it shall proceed to mediation before a neutral mediator agreed upon by both parties, or appointed by a recognized mediation agency if no agreement is reached within fifteen (15) additional days. Mediation costs will be shared equally, and sessions may take place in person or virtually.

If mediation fails, the matter shall be settled by binding arbitration under the commercial arbitration rules of the American Arbitration Association (AAA) or a similar institution. The arbitration shall be conducted in English, by a single neutral arbitrator, in the State of WI. The arbitrator’s decision will be final and binding, and may be enforced in any competent court.

Both parties waive any right to bring a lawsuit in court or to participate in a class action, unless required by applicable law. Awesome Maid LLC may, however, seek injunctive or equitable relief directly in court for intellectual property violations, misuse of the platform, or actions causing irreparable harm.

 

14. APPLICABLE LAW

These terms and conditions shall be governed by and construed in accordance with the laws of the United States. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the state or federal courts of the State of WI. This applies unless binding arbitration is agreed to in the applicable section.

 

15. FINAL PROVISIONS

Your use of our website and services is conditioned upon your acceptance of and compliance with all of the terms and conditions set forth. This authorization to use our services does not extend to jurisdictions where these provisions are not respected or applied.

Our commitment to compliance with these terms is strictly governed by applicable laws and legal process. Importantly, these terms do not restrict our ability to comply with legal or governmental requirements, including but not limited to those related to law enforcement and the use of our website. Information provided or collected in connection with the use of the website will be subject to these requirements.

In the event that any provision of these terms and conditions is declared invalid, illegal or unenforceable by a court or competent authority, such decision shall not affect the validity or enforceability of the remaining provisions. Failure or delay in enforcing any of these terms and conditions by us at any time shall not constitute a waiver of our rights to enforce such provision, or any other provision, in the future.

We reserve all rights not expressly granted herein, while at all times maintaining the protection of and respect for our intellectual property rights and prerogatives.
